TERMS OF SERVICE

By commissioning me, the Artist, you — the Client — agree to the following terms:

GENERAL

- I reserve the right to decline any commission for any reason, such as content, subject matter, or other reasons.- Currently, all commission work is done digitally on Clip Studio Paint. Commission work and any other deliverables are digital, and there are no physically shipped goods to receive.- I will perform to the best of my ability in good faith and warrant that my work is 100% original to my best knowledge.- Unless explicitly requesting commercial usage of a commission, all prices are adjusted for personal usage only. These works thus fall under personal use and its limitations. See the Client Permissions section for additional details.

CONTENT RESTRICTIONS

- I will not create content that is explicit, offensive, or inappropriate. Specific restrictions comprise, but are not limited to, the following:- NSFW content of any kind, including suggestive content, fetish content, and major gore.- I do not create political or religious propaganda of any kind.- I do not have an expertise in Mecha, other art styles beyond the work provided in my portfolio, and realism, e.g., still-life studies or portraits depicting real people or pets.

CONTENT SPECIALIZATIONS

- I am more than happy to facilitate the creation of the following in my art style:- I specialize in Splatoon and Roblox avatars and would love to draw these!!- I love drawing shipping between two or more characters!- I encourage Original characters/personas as well!- Anthropomorphic characters (anthros), furries, and kemono are also more than welcome to be requested!- Feel free to request fanart!- I can draw Pokemon!- You may request soft/minimal amounts of gore! This comprises non-fatal injuries and wounds that do not expose the inside of a body!

CLIENT PERMISSIONS

- You receive exclusive, non-transferable rights regarding the usage of commissioned work, including the following:- You may display the work on social media with no direct monetization. Examples include profile pictures, posts, and banners.- You may print and frame commissions in personal spaces!- You may display your commission as part of designs on websites and channels. This excludes the use of these commissions within the content of these websites or channels itself.- You may not utilize commissions for any commercial or profit-oriented reasons, i.e., resell the work in any way.- You may not claim the commissioned work as your own — please attribute it to my social tag, Cosmiblight. You may also link my Bluesky, Twitter/X, or other social platform accounts with my presence in instances you display this work on websites, social media profiles, broadcast channels and so on.- You may not heavily edit/alter the commission.- You may not utilize commissions for AI (artificial intelligence) tools, platforms or programs and ML (machine learning) tools, platforms or programs. AI or ML training, NFT, blockchain, or other for-profit platforms/purposes are also strictly prohibited.

ARTIST PERMISSIONS

- I retain the copyright, ownership, redistribution and intellectual property rights to any commissioned work.- I reserve the right to present the work and its work-in-progress iterations on social media, portfolios, and public broadcast channels. Social medias and portfolios will have appropriate protections to prevent theft of the work.

TIMELINE & PROCESS

- Please provide clear and complete reference materials and assets upfront. Clear expectations are vital for easy inquiries!- You, the client, act as the main point of contact and are solely responsible for decisions and approval during the process.-I will define the scope of work, features, price, deliverables, and other details for the project in a proposal. This quote is sent in a format according to my discretion, which may entail private message or email. The details set forth shall be approved before work begins.- Work completion requires 1 week minimum, and may take up to 6 weeks depending on each project.- This timeline depends on commission type, complexity, and workload.- If there are any delays and necessary adjustments to timeline, I will inform you ASAP.- I will do my best to ensure we come to a compromise regarding delays and amendments to the timeline exceeding 6 weeks through standard communication channels.

COMMUNICATION

- Standard communication channels include Private Messages on social platforms such as Discord, X (Twitter), and Bluesky, according to my discretion.- Ongoing communication and discussion will occur throughout the project. I send updates when I start your sketch, when the sketch is sent, and when I begin finalizing the commission. I will also communicate to help with idea generation and collaboration, for situational updates, and more.- My response time may vary, up to 3 days, in order to provide better or more concrete updates.

REVISIONS

- You may request up to two minor revisions and one major revision for free before the sketch is approved.- You may request up to one minor revision for free before flats are approved for rendering.- Examples of minor revisions include, but are not limited to: changes in facial expression, changing the pose of extremities, e.g. hands and feet, and color changes that constitute fewer than 40% of the canvas.- Examples of major revisions comprise the following: drastic changes in posing, angle, perspective, and/or composition. Color changes involving more than 40% of the canvas are also considered major alterations.- A fee for 10% of the quoted price is applied for every subsequent minor revision requested. This fee increases to 30% after 5 total revisions.- A fee for 30% of the quoted price is applied for every subsequent major revision requested. This fee increases to 50% after 5 total revisions.- Please bear in mind: revisions affect progress and may shift the timeline!

PAYMENTS & FEES

- Half of the quoted price is paid upfront as a 50% down payment, and the other half after the product is sent.- Prices are in USD, and paid via Paypal or Venmo.- I will send an invoice when I am ready to begin work. Please do not send money before these requests for payment!- Invoices must be paid within 48 hours, or the project may be cancelled and your spot in queue lost.

CANCELLATION & REFUNDS

- You warrant you will not issue charge backs, and the refund policy mentioned below will be followed.- No refunds are possible after work begins unless initiated by me.- If a commission cannot be completed, or there are delays as detailed in the Process section for unforeseen reasons, you may be eligible for a full refund.- If work done up to this point is accepted and used, however, I will provide a 50% refund. You will then be allowed to use what I have sent as per the Client Permissions section.- You have the right to request refunds 7 days after deadlines if the commission has not been delivered and there was no agreed upon amendment to the timeline.

DELIVERABLES

- Final deliverables are provided via file transfer tools, such as Google Drive, Google Mail, or other social media outlets, such as my Discord, Twitter, or Bluesky.- Upon completion of the work, I will deliver a high-resolution transparent .PNG file and .TIF file through standard communication channels.- Emote commissions include a 300px x 300px size as well. You may ask for other sizes upon request.- If you provide a Google Mail address, I will also deliver the commission through [email protected].- Upon request, I send non-transparent and striped background versions of a commission for free!

CONFIDENTIALITY

- By commissioning me, we acknowledge information and materials that are provided to either party (including, but not limited to, personal information, technical information, marketing plans, payment information, or sensitive business information), or are incorporated into the deliverables, shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information. Information that will not be visible to the public will stay private.

This site consolidates and showcases my work, featuring both personal and commissioned pieces, with the intent of providing a general idea of my capabilities as a working artist.
